New Laws and Why They Matter

This is a pivotal moment, following California’s groundbreaking mandate (AB 2375), which took effect on July 1, 2025. The law requires bars and restaurants holding a Type 48 license to provide drink covers upon request—the first state-wide legislation of its kind in the U.S. But there are more states to come!

NightCap drink protectors align perfectly with this new law, providing a practical solution that helps venues comply while giving patrons added safety. With many states expected to follow California’s lead, this marks a significant step forward in addressing drink spiking and protecting patrons in nightlife venues.

By combining education, actionable guidelines, and innovative protective tools, this initiative helps the industry stay ahead of emerging regulations and continue to raise the standard for safety, respect, and accountability.

AboutNightCap®

NightCapIt® is the drink spiking prevention company behind the viral Shark Tank product designed to help protect yourself when going out. The idea was born after founder Shirah Benarde’s friend had her drink spiked. Shirah dreamed of a simple solution, a scrunchie that could double as a drink cover, and created the very first NightCap prototype the next day out of her mom's stockings and a scrunchie from her room.

Today, NightCap offers reusable and disposable innovative products that act as an effective barrier between your drink and potential tampering. Trusted by millions worldwide, NightCap empowers individuals to take control of their safety while enjoying nights out, concerts, festivals, and everyday social settings. You should never leave your drink unattended with or without a NightCap!
